It appears that the Founding Fathers intents are being perfectly carried out through this navy JAG. The U.S. government, as most everyone knows, was set up with a system of checks and balances to prevent any single branch from becoming too powerful. This JAG has seen where the executive branch is trying to overstep it's limits through improper legislation from Congress. He is properly using judicial powers granted to him to determine whether or not his superiors actions are justified.

I do still believe that war time sometimes call for extreme situations that appear to have only a single solution at the time. However, we have often looked back and determined other means or recognize that our democracy is entirely unique with a judicial system that has to prove guilt.

I'm going to have to say that I support his effort and that as soon as we move away from the ideals America was built on we lose our edge that shows America holds the higher moral ground. We should never walk away from that.

The military is not part of the executive branch. Sure, we're under the direct command of the POTUS, but at any point Congress can call an officer to the stand and he or she must answer truthfully.

The military answers to the Constitution first and foremost. We have to disobey an unlawful order, including those that come from the President.
